{"id":10391,"date":"2024-12-19T15:53:49","date_gmt":"2024-12-19T18:53:49","guid":{"rendered":"https:\/\/aldiachaco.com.ar\/?p=10391"},"modified":"2024-12-19T15:53:49","modified_gmt":"2024-12-19T18:53:49","slug":"caso-cielo-la-menor-habia-manifestado-su-deseo-de-quedarse-con-la-madre","status":"publish","type":"post","link":"https:\/\/aldiachaco.com.ar\/index.php\/2024\/12\/19\/caso-cielo-la-menor-habia-manifestado-su-deseo-de-quedarse-con-la-madre\/","title":{"rendered":"Caso Cielo: la menor hab\u00eda manifestado su deseo de quedarse con la madre"},"content":{"rendered":"<h5><strong>Este jueves, se dio a conocer el informe que realiz\u00f3 Gabriela Carolina Colef, la asesora de ni\u00f1as, ni\u00f1os y adolescentes N\u00ba 5, sobre la ni\u00f1a Cielo, a quien arrancaron de los brazos de su madre en un operativo violento y pol\u00e9mico.<\/strong><\/h5>\n<p>Seg\u00fan expone en el informe presentado ante el Poder Judicial del Chaco y realizado tras el operativo,\u00a0<strong>se present\u00f3 junto a un equipo en el inmueble de la menor, donde fueron atendidos por Ozoj Brajovich, quien los hizo ingresar a la vivienda<\/strong>. &#8220;All\u00ed se encontraba almorzando el grupo familiar, mientras que Cielo estaba en el ba\u00f1o. El Oficial de Justicia inform\u00f3 cu\u00e1l era la medida que hab\u00eda sido ordenada&#8221;, expres\u00f3.<\/p>\n<p>&#8220;Seguidamente, ingres\u00f3 a la sala la ni\u00f1a.\u00a0<strong>La madre pidi\u00f3 que se le explicara a la menor lo que estaba sucediendo y a tal fin, la tutora ad litem consult\u00f3 en qu\u00e9 lugar pod\u00edan hacerlo de manera reservada, por lo que accedieron al dormitorio de la ni\u00f1a junto con la psic\u00f3loga D\u00edaz&#8221;<\/strong>, sostuvo.<\/p>\n<h5><strong>Ambas profesionales informaron sobre la negativa de la ni\u00f1a de ser retirada de la vivienda y llevada con sus abuelos paternos.<\/strong><\/h5>\n<div class=\"google-auto-placed ap_container\"><ins class=\"adsbygoogle adsbygoogle-noablate\" data-ad-format=\"auto\" data-ad-client=\"ca-pub-3253653980802987\" data-adsbygoogle-status=\"done\" data-ad-status=\"filled\"><\/p>\n<div id=\"aswift_4_host\"><\/div>\n<p><\/ins><\/div>\n<p><strong>&#8220;Ante tal negativa (transmitida por las profesionales) solicit\u00e9 al Oficial de Justicia que se deje constancia de ello y de mi pedido a la se\u00f1ora Jueza de que se reval\u00fae la medida<\/strong>, por cuanto retirarla en contra de su voz, pod\u00eda ocasionar mayor afectaci\u00f3n a su bienestar general&#8221;, dijo Colef.<\/p>\n<p>&#8220;Asimismo, proced\u00ed a comunicarme telef\u00f3nicamente con mi superior, a los fines de informar lo que estaba sucediendo y\u00a0<strong>mi oposici\u00f3n a que ingrese la Polic\u00eda a retirar a la ni\u00f1a. Recibiendo como respuesta que la orden ya hab\u00eda sido dada<\/strong>\u00a0, y de la cual no tuve tiempo material de notificarme, atento a la inminencia del horario de su efectivizaci\u00f3n, del que fui notificada telef\u00f3nicamente&#8221;, puntualiz\u00f3.<\/p>\n<div class=\"google-auto-placed ap_container\"><ins class=\"adsbygoogle adsbygoogle-noablate\" data-ad-format=\"auto\" data-ad-client=\"ca-pub-3253653980802987\" data-adsbygoogle-status=\"done\" data-ad-status=\"filled\"><\/p>\n<div id=\"aswift_5_host\"><\/div>\n<p><\/ins><\/div>\n<p class=\" aBigClassNameToAvoidCollisionInText\"><strong>&#8220;El Oficial de Justicia comunic\u00f3 que la orden impartida era que a\u00fan, ante la negativa, deb\u00eda retirar a la ni\u00f1a<\/strong>\u00a0\u00a0y fue as\u00ed que todos volvimos a colaborar de manera pac\u00edfica a tal fin: la suscripta, la tutora ad litem, y la licenciada Diaz (aunque en esa oportunidad las dem\u00e1s profesionales que permanec\u00edan en la vereda dijeron no estar autorizadas, sino que su participaci\u00f3n era s\u00f3lo de observaci\u00f3n). No obstante, ello y luego de transcurrido un tiempo en el que la martillera intent\u00f3 tambi\u00e9n retirar a la ni\u00f1a de manera infructuosa, fue que ingres\u00f3 la licenciada D\u00edaz informando que hab\u00eda sido autorizada por la licenciada Sandra Zaracho, a ingresar&#8221;, relat\u00f3 la asesora.<\/p>\n<div id=\"video\"><\/div>\n<p><strong>&#8220;En ese momento, la ni\u00f1a que permanec\u00eda llorando a upa de su mam\u00e1, se tranquiliz\u00f3, pero manten\u00eda su negativa rotunda de ver a sus abuelos.<\/strong>\u00a0El tiempo de demora en la diligencia fue la respuesta respetuosa que todos los intervinientes intentamos dar a la ni\u00f1a. Es decir: escuchar sus razones con calma, asegurar que tenga espacio para expresarse sin presiones, validar sus sentimientos y evitar cualquier situaci\u00f3n que pueda resultarle traum\u00e1tica&#8221;, continu\u00f3.<\/p>\n<p><strong>&#8220;No obstante, y mientras est\u00e1bamos junto a la ni\u00f1a y su madre, conforme lo dispone el oficial de justicia, ingresaron a la vivienda la Polic\u00eda y tambi\u00e9n los abuelos paternos, quienes retiraron a la menor, ejerciendo fuerza respecto de la ni\u00f1a y de la madre<\/strong>.\u00a0<strong>La reacci\u00f3n de la ni\u00f1a fue de llanto desconsolado y manten\u00eda su resistencia verbal y f\u00edsica.<\/strong> Situaci\u00f3n que a criterio de la suscripta puede derivar en un da\u00f1o emocional. No obstante, lo cual la diligencia continu\u00f3 por la fuerza&#8221;, indic\u00f3 Colef.<\/p>\n<p>&#8220;Por lo expuesto, y en resguardo del inter\u00e9s superior de la ni\u00f1a, quien adem\u00e1s\u00a0<strong>estar\u00e1 privada del contacto materno y con su hermanita hasta, al menos, el d\u00eda 10 de febrero del 2025, solicito:<\/strong><\/p>\n<p><strong>I) Se eval\u00fae lo acontecido durante la diligencia y se reexamine la medida de guarda otorgada<\/strong>, teniendo en cuenta la negativa firme y el impacto emocional que ha generado en la ni\u00f1a.<\/p>\n<p><strong>II) Se mantenga la orden de terapia para la ni\u00f1a en Salud P\u00fablica, conforme el turno asignado en fecha pr\u00f3xima, y que sea su madre quien la acompa\u00f1e<\/strong>, a los fines de que el mismo no sea perdido. Ello, teniendo en cuenta que el derecho fundamental a resguardar en este caso es la salud integral de la menor, conforme los instrumentos internacionales de Derechos Humanos largamente citados a lo largo de las numerosas causas que involucran a la ni\u00f1a y por todas las partes.<\/p>\n<p>III) Se requiera informe al EIU de lo observado en la diligencia como as\u00ed tambi\u00e9n su opini\u00f3n t\u00e9cnica, respecto de reconsiderar la situaci\u00f3n actual y garantizar los derechos de la ni\u00f1a.<\/p>\n<p><strong>IV) Se habiliten d\u00edas y horas inh\u00e1biles teniendo en cuenta la gravedad del caso&#8221;<\/strong>, concluy\u00f3 la asesora.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Este jueves, se dio a conocer el informe que realiz\u00f3 Gabriela Carolina Colef, la asesora de ni\u00f1as, ni\u00f1os y adolescentes N\u00ba 5, sobre la ni\u00f1a Cielo, a quien arrancaron de los brazos de su madre en un operativo violento y pol\u00e9mico.
